A. If you are under 18 years you will require your parents' or guardian's consent to take part in this audition and a proof of your age will be required.

B. You must be a New Zealand citizen or hold a New Zealand Residence Permit.

C. You are required to abide by the rules and terms and conditions (the Rules) of the "Coca‑Cola Christmas in the Park" (the Show) as devised from time to time by the Producer and will accept the decision of the Producer as final and acknowledge that the interests of the Show will override those of any contributor, including yourself.

D. You will not enter into any commercial or other sponsorship agreement or arrangement with any person, firm or company in respect of your appearance in the Show and can confirm that as at the date of this agreement and for the duration of the Show, you are not party to and will not be party to any contract or arrangement in respect of your musical or performing abilities which might breach the Rules or prevent your full and free participation in the Show.

E. Submitting an application form constitutes your consent to the Producer using your name, photographs, and Show footage for promotional purposes, without further compensation, and waiving any claims to royalty, right or remuneration. You will assign irrevocably to the Producer (including present assignment of future copyright) the entire copyright and all other rights of whatsoever nature in and to your contribution to the Show including but not limited to any literary, dramatic, musical or artistic work (within the meaning of the Copyright Act 1994 (the Act) incorporated therein in which you own copyright (the Contributions) such that the Producer will be entitled to use and exploit and license others to use and exploit such Contributions by all means and in all media and formats whether now known or hereafter invented throughout the universe for the full period of copyright including any extensions and renewals thereto and thereafter insofar as is possible in perpetuity. Furthermore, you also waive all moral rights that you have in relation to the products of your services in relation to the Show, including without limitation full waiver of the rights specified in sections 94 and 98 of the Act (Moral Rights) pursuant to section 107 of the Act.

F. Without limiting the above, the Producer will be entitled to: (a) alter, adapt or make additions to or deletions from the Show (and your appearance thereon) at its discretion; (b) make and exploit and to authorize the making and exploitation of any recording or fixation of your appearance separately from or in conjunction with the Show throughout the universe in perpetuity in all media whether now known or hereafter invented; (c) dub your voice in any language; and (d) include your name, likeness, voice, biographical details (which includes, without limitation, any personal information as defined in the Privacy Act 1993 or otherwise) and photographs of you in all media and formats throughout the universe including but not by way of limitation in advertising, publicity and exploitation material.

G. You acknowledge and agree that the Producer's labour and expense in making arrangements for the filming and recording of the Contributions and the opportunity provided to you to potentially appear in or in association with the Show (the Benefits) include sufficient and adequate consideration for the use and exploitation of the Contributions and the Show (including without limitation your appearance in the Show) by any means and media, anywhere in the universe and you waive any right and/or entitlement to any equitable relief, remuneration or other payment howsoever arising in connection with such use or exploitation. You further acknowledge and agree that the Benefits also include full and final consideration for your attendance at any and all activities as required by the Producer in connection with the Show.

H. You acknowledge and agree that no repeat fees will be payable to you in respect of any subsequent rebroadcast or retransmission or any other use by the Producer (or any assignees or licensees) of the Show or any part thereof.

I. The Producer will not be liable to your legal representative, or you, for any loss or damage or injury to you or your property caused by or suffered during or in connection with taking part in the Show.

J. You agree not to disclose to any third party (other than your professional advisors) without prior written consent from the Producer any information relating to the Show, your appearance, any of the production team, any participants in the Show, the broadcaster nor any other information which may come to your attention relating to the affairs of the Producer (or any associated company) which may come to your knowledge during or in connection with your participation in the Show.

K. If you are contacted by the media, you agree to refer them to the Producer.

L. You agree that you will truthfully and accurately complete all forms and that the answers and information you will supply will be in no way misleading. You furthermore acknowledge that the Producer reserves the right exercisable at any time at its sole discretion to disqualify you from the Show should you at any stage supply untruthful, inaccurate, or misleading personal details and information, or break the Rules.

M. The Producer may assign your services and all other rights in your Contributions to and participation in the Programme to any third party.

N. It is the Producer's decision about who will or will not participate in the Show. No correspondence will be entered into in connection with any decision made by the Producer.

O. The Courts of New Zealand shall have sole jurisdiction in relation to the terms and conditions of the agreement contained in this release, which will be interpreted according to the laws of New Zealand.

P. These terms and conditions can be amended at any time with due notice.

R. BY SUBMITTING YOUR APPLICATION, YOU AGREE TO THE CONDITIONS SET OUT ABOVE AND AGREE THAT ALL THE INFORMATION GIVEN IN THIS FORM MAY BE USED IN CONNECTION WITH THE EVENT AT THE PRODUCER'S SOLE DISCRETION.
