COCA-COLA® CANADA’S KINDEST COMMUNITY CONTEST

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID OUTSIDE THE ELIGIBILITY AREA AND WHERE PROHIBITED.

1. Eligibility: The Coca‑Cola Canada’s Kindest Community Contest (the “Contest”), is open only to legal residents of Canada (“Eligibility Area”) who are 13 years of age or older at time of entry (“Entrant”). Entrants do not win a prize; they are entering on behalf of their city/municipality (“City”) that will be awarded the prize. Any Entrant who is under the legal age of majority in their province/territory of residence (a “Minor”) must have the consent and permission of their parent or legal guardian to enter. Void outside the Eligibility Area and where prohibited or restricted by law. Employees and non-employee workers of Coca‑Cola Ltd. (the “Sponsor”), The Coca‑Cola Company, Coca‑Cola Canada Bottling Limited, Coca‑Cola bottlers, Don Jagoda Associates, Inc. (“Administrator”), WPP plc, IfThen Digital LLC, and any of their respective parent companies, affiliates, subsidiaries, advertising agencies, and any other company or individual involved with the design, production execution or distribution of the Contest (collectively, the “Released Contest Parties”) and their immediate family (defined for the purposes of these Official Rules as: spouse, parents and step-parents, siblings and step-siblings, and children and step-children) and household members (people who share the same residence at least three [3] months out of the year) of each such individuals are not eligible. This Contest is subject to all applicable provincial, and local laws and regulations. Participation constitutes Entrant’s (and their parent/legal guardian on their behalf if the Entrant is a Minor) full and unconditional agreement to these Official Rules and Sponsor’s and Administrator’s decisions, which are final and binding (without right of appeal) in all matters related to the Contest. Winning the Prize is contingent upon fulfilling all requirements set forth herein.

2. Contest Period: The Contest begins at 10:00 am Eastern Time (“ET”) on November 13, 2024 and ends at 11:59 pm ET on January 6, 2025 (“Contest Period”).

3. How to Enter: There is NO PURCHASE NECESSARY to enter on behalf of your City. A purchase does not increase your City’s chances of winning. During the Contest Period, visit here (“Website”) and follow the instructions to complete the registration form including the City of your local community that you would like the prize to be awarded to and share your short act of kindness story in sixty (60) words minimum and five hundred (500) words maximum to receive one (1) entry into the Contest (“Entry”). Limit one (1) Entry per person/email address. Entries will not be judged.

  • Please make sure to note the following regarding your Entry: The Entry must not contain content that is known by you to be false, inaccurate or misleading.

  • Any Entry deemed inappropriate or unsuitable, in Sponsor’s sole discretion, will be disqualified. Entry must not contain material that is inappropriate, indecent (including but not limited to nudity, or pornography), profane, obscene, hateful, tortuous, defamatory, slanderous or libelous (including words or symbols that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation, or socioeconomic group).

  • Entry must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.

  • The Entry must not contain criminal or tortuous activity, including but not limited to child pornography, fraud, trafficking of obscene material, drug dealing, drug use, or gambling. Entry must not contain material that is unlawful, in violation of or contrary to all applicable local, state, federal, or international laws and regulations.

  • Any Entry or portion thereof that is, in Sponsor’s sole discretion, obscene, profane, lewd, defamatory, contains any third-party materials, other than The Coca‑Cola Company related materials, or otherwise violates or infringes (or may infringe) any copyright or trademark that identifies a brand or other proprietary right of any person living or deceased (including but not limited to rights of privacy or publicity or portrayal in a false light) or entity or make reference to any commercial/corporate advertising (including but not limited to brand names, slogans, political, or religious statements), or is otherwise objectionable, will not be considered and will disqualify the Entrant.

  • Entry must not include any representation of celebrities, athletes, musicians, or any other public or private figure, include any anti-social, political or religious groups, any commercial solicitation or promotional materials or name, address, phone number, or URL address.

  • Entry must not contain advertisements, personal solicitations or commercial solicitations.

  • Entrants and all submitted Entries must be in keeping with Sponsor's image/The Coca‑Cola Company or brand image as determined by Sponsor, in its sole discretion, or Entry will be disqualified from the Contest. The Entry must not disparage persons or organizations associated with Sponsor.

  • Entrants and all submitted Entries may not negatively reference any of The Coca‑Cola Company’s competitors, in Sponsor’s sole discretion.

All Entries become the property of Sponsor upon submission and will not be returned. Any attempt by any Entrant to obtain more than one (1) Entry by using multiple email addresses, identities, registrations or logins, or any other methods will void that Entrant’s Entries and that Entrant may be disqualified from the Contest. Any use of robotic, repetitive, automatic, programmed or similar Entry methods or agents (including, but not limited to, Contest Entry services) will void all Entries by that Entrant. In the event of a dispute as to any Entry, the authorized account holder of the email address used to enter will be deemed to be the Entrant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winner may be required to show proof of being the authorized account holder. Message and data rates apply to use of mobile device. You may be charged by your wireless carrier for participating via mobile device. It is therefore recommended that you consult your wireless carrier's pricing plan BEFORE participating via mobile device. Not all mobile devices offer wireless Internet access; and wireless Internet access may not be available in all areas.

All Entries submitted become the property of Sponsor upon submission and will not be returned. Each Entrant and the parent or legal guardian of any Minor Entrant/winner by entering, grants to Sponsor a worldwide, royalty-free, perpetual, non-exclusive right and license to copy, distribute, and display each submitted Entry in any media, and with right to use, copy, modify, edit, and create derivative works there from. Any Entry deemed inappropriate or unsuitable, in Sponsor’s sole discretion, will be disqualified. By entering, you or your parent or legal guardian if you are a Minor, understand that your Entry (or portion thereof) may be posted online, in Sponsor’s sole discretion, to be viewed by members of the general public. Entrants may not copy or otherwise plagiarize any portion of the Entry from any source. No information regarding Entries or judging, other than as otherwise set forth in these Official Rules or on the website listed above, will be disclosed. All eligible Entries must be received during the Contest Period and will be verified prior to Entry tabulation. NOTE: Entrants/Cities are prohibited from obtaining or soliciting Entries by offering prizes, payments, or inducements for Entries for that City, or engaging in other conduct that is not considered fair play, as determined by the Sponsor in its sole discretion and Sponsor may void all Entries associated with such conduct.

4. Winning City Determination: On or about January 7, 2025, all eligible Entries received for each City will be verified and the City that receives the most valid Entries per capita during the Contest Period will be determined the potential Grand Prize Winning City. Determination per capita is based on Statistics Canada 2021. All details of the winner determination are in Sponsor’s/Administrator’s sole discretion and determination may be made at Administrator’s offices in Melville, NY USA.

5. Grand Prize (1): $50,000 CAD, awarded to a community foundation or community partner organization identified by Community Foundations of Canada in collaboration with the Sponsor, within the jurisdiction of the winning community. Community Foundations of Canada will collaborate with a local community foundation or community partner organization within the jurisdiction of the winning community to determine the authorized representative responsible for receiving the funds. Funds will be distributed directly through Community Foundations of Canada, in alignment with the Sponsor’s guidelines and discretion.

6. City Notification: The Sponsor will work with the City officials to determine who is the authorized representative that may execute and return prize documents on behalf of the City’s local organization and that authorized representative will then be required to sign and return a Declaration of Eligibility/Liability Release and except where prohibited, publicity release and assignment of rights (“Declaration”) within five (5) days of notification in order to be confirmed the winner. If the authorized representative fails to return the completed Declaration or the authorized community representative fails to correctly answer the arithmetic skill-testing question or is deemed ineligible, within five (5) days, Declaration is returned as undeliverable, the prize will be forfeited and an alternate potential winning City will be determined for the Grand Prize and the entire process will continue for the next alternate. Upon prize forfeiture, no compensation will be given. Grand Prize winning authorized community representative grants a royalty-free, perpetual, non-exclusive right and license to copy, distribute, use and display any photo or video footage taken of the community organization or City/area (before and/or after) or the name and likeness of it (“Footage”) in any media, and with right to use, copy, modify, edit, and create derivative works there from, and they agree to execute documents confirming such right and license in the Declaration. Up to three (3) alternates may be determined based on the next highest number of eligible Entries received.

7. General Rules: By participating in the Contest, Entrants (or their parent/legal guardian if the Entrant is a Minor) and winning authorized representative agree to be bound by these Official Rules and the decisions of the Sponsor/Administrator. Sponsor/Administrator’s decisions are final on all matters relating to the Contest. Any normal Internet/phone access and data/usage charges imposed by Entrants’ online/phone service will apply and are Entrants’ sole responsibility. Entrants once verified, may be required to show proof of being the authorized account holder of the email address assigned by an Internet access provider, online service provider, Internet service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted address. Entries specifying an invalid, non-working, or inactive email address may be disqualified. No information regarding Entries, other than as otherwise set forth in these Official Rules or on the Website, will be disclosed. Sponsor and the other Released Contest Parties are not responsible for lost, interrupted or unavailable network server or other connection; miscommunications; failed phone or computer or telephone transmissions; technical failure; jumbled, scrambled or misdirected transmissions; late, lost, incomplete, delayed, or misdirected Entries; or other error of any kind whether human, mechanical, or electronic. CAUTION: Any attempt to deliberately damage any web site/device, or undermine the legitimate operations of the Contest, is a violation of the criminal and civil laws. Should such an attempt be made, the Sponsor reserves the right to seek damages from any such participant to the fullest extent permitted by law and to disqualify such Entrant from the Contest. In the event the Contest is compromised or impaired in any way for any reason, including but not limited to, fraud, virus, bug, unauthorized human intervention, outbreak of widespread illness, pandemic, or other similar occurrence, civil unrest or any other problem or other causes beyond the control of Sponsor that corrupts or impairs the administration, security, fairness, or proper play of the Contest, Sponsor reserves the right in their sole discretion to suspend or terminate the Contest and determine the Grand Prize winning City from among all eligible Entries received prior to cancellation. Sponsor and the other Released Contest Parties are not responsible for lost, late, misdirected, corrupted, or incomplete Entries. Proof of submission is not proof of receipt by Sponsor. The Sponsor reserves the right at their sole discretion to disqualify any individual that tampers or attempts to tamper with the Entry process or the operation of the Contest or Website; violates these Official Rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. The Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. By participation in the Contest, Entrants, parent or legal guardian for any minor Entrants and Grand Prize winning authorized representative release and hold harmless the Released Contest Parties from and against any and all liability, claims, or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with submitting an Entry or otherwise participating in any aspect of the Contest, the receipt, ownership or use of  prize awarded, or while preparing for, participating in any prize-related activity or any typographical or other error in these Official Rules or the announcement or offering of the prize.

8. By submitting an Entry, you (or your parent/legal guardian if you are a Minor) hereby grant the Sponsor, its affiliates, subsidiaries, assigns, licensees, and legal representatives the irrevocable, perpetual, worldwide right to use, reproduce, edit, market, store, distribute, have distributed, publicly and privately display, communicate, publicly and privately perform, transmit, have transmitted, create derivative works based upon, and promote the Entry (as such may be edited and modified by the Sponsor in its discretion) for editorial, commercial, promotional and all other purposes (including posting on any websites). In addition, you (or your parent/legal guardian if you are a Minor) hereby assign to the Sponsor all rights, titles, and interests that you may be deemed to have in any reproduction, product, or derivative work using or incorporating the Entry. You (or your parent/legal guardian if you are a Minor) represent and warrant that: (i) the Entry does not and shall not infringe on any copyright or trademark or any other third-party right nor violate any applicable law or regulation, (ii) you have the right to grant any and all necessary rights and licenses provided herein, including without limitation, all necessary copyright, trademark and other related rights to the entry, free and clear of all claims and encumbrances without violating the rights of any person or entity, including any right to privacy or publicity. You (or your parent/legal guardian if you are a Minor) waive any right to inspect or approve uses of the Entry or to be compensated for any such uses. You (or your parent/legal guardian if you are a Minor) hereby release Sponsor, its affiliates, officers, directors, agents, co-branders or other partners, and any of its employees (collectively, the "Contest Parties"), harmless from any and all claims, damages, expenses, costs (including reasonable attorneys' fees) and liabilities (including settlements), brought or asserted by any third party against any of the Contest Parties due to or arising out of your participation in the Contest, or use of your name, likeness, Entry and/or voice, or any other rights granted to Sponsor, including any claims for including but not limited to trademark, copyright, or other intellectual property rights, right of publicity, right of privacy or defamation. You (or your parent/legal guardian if you are a Minor) further agree to release and indemnify and hold harmless Contest Parties from any and all claims that any commercial, advertising, presentation, web content or any other material subsequently produced, presented, and/or prepared by or on behalf of Contest Parties infringes on your rights as contained in the Entry/Content. Sponsor and their respective affiliates, officers, directors, agents, and employees will have no liability or responsibility for any claim arising in connection with participation in this Contest or any prize awarded. Disputes: Entrant (and their parent/legal guardian on the Entrant’s behalf if the Entrant is a Minor) agrees that to the fullest extent permitted by law: (a) they release and will defend, indemnify and hold harmless the Sponsor and all of the other Released Contest Parties from and all any and all claims; (b) claims arising out of or connected with this Contest, or any prize awarded shall be resolved individually, without resort to any form of class action, and solely and exclusively in a federal or provincial court located in Toronto, Ontario in Canada; (c) Entrant submits to sole and exclusive personal jurisdiction to said courts in Toronto, Ontario in Canada for any such dispute and irrevocably waives any and all rights to object to such jurisdiction; (d) any and all claims, judgments, and awards shall be limited to actual damages of no more than $100 CAD, including costs associated with entering this Contest, but in no event attorneys' fees; and (e) under no circumstances will Entrant be permitted to obtain awards for and Entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. To the fullest extent permitted by law, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Entrants, authorized City representative or the Released Contest Parties in connection with this Contest shall be governed by, and construed in accordance with, the laws of the Province of Toronto, Ontario in Canada, without giving effect to any choice of law or conflict of law rules of provisions (whether of the Province of Toronto, Ontario in Canada, Canada, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Province of Toronto, Ontario in Canada. FOR QUEBEC RESIDENTS ONLY: Any litigation respecting the conduct or organization of a Contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement.

9. Privacy Policy: Information collected by Sponsor in connection with this Contest may be used by Sponsor and shared with third parties involved in administration of the Contest in accordance with the Sponsor’s online Privacy Policy posted here. The Entrant/authorized City representative hereby agrees to the collection, processing and storage of his/her personal data by Sponsor for the purposes of the Contest. All information submitted will be transferred to the U.S.
