IMPORTANT: Please read these terms and conditions ("Terms and Conditions") before entering this promotion ("Promotion") provided by Coca‑Cola Far East Limited, whether directly or through the appropriate agents (together referred as the "Promoter"). By entering this Promotion, you confirm that you have read, understood, and agree to comply with these Terms and Conditions.

A. ELIGIBILIY

This Promotion is valid in the Philippines only and is open to everyone who meets the following requirements
(“Participant”):

1. Residing in the territory of the Philippines;

2. Minimum of 13 years old;

3. Agrees to the Terms and Conditions and Privacy Policy that apply to this Promotion. For Participants who are under 18 years old, by participating in this Promotion, Participants declare that they have obtained permission from their parents or legal guardians to take part in the Promotion and are subject to these Terms and Conditions and the Privacy Policy that applies to this Promotion;

4. Has a valid official identity card (such as passport, government issued ID, school ID, etc.); and

5. Not employees and immediate family members (spouses, parents, siblings, children and each of their spouses of the Promoter, partners, distributors, agencies, companies or participating businesses associated with this Promotion (and their respective parents, affiliates, subsidiaries and related companies including ESSENCE MEDIACOM, WPP/OGILVY/BATES, ANTSAVVY CREATIVES, employees of the FDA (collectively, “Affiliates”)
(b) prohibited under the laws of your country of citizenship, residency or domicile to participate in any games of chance and/or skill, or this Promotion.

6. If winner is under 18 years old, winner must be accompanied by a parent/legal guardian upon claiming the prize. If the parent/legal guardian claims the prize on behalf of the minor, OR, if the winner is unable to claim the prize himself/herself, a representative, must present the following necessary documents:

a. A letter of authorization duly signed by the winner, authorizing the parent/legal guardian, or representative as the acknowledged recipient of the prize on the winner’s behalf;
b. Label with unique alphanumeric code;
c. Original notification with the unique code sent from Coca‑Cola FB Messenger;
d. Two (2) original IDs of the winner;
e. Two (2) original IDs of the representative/legal guardian.

B. PROMOTION PERIOD

1. This Promotion starts from 05/08/2024 and ends on 20/10/2024 (“Promotion Period”).

2. Any entry not received during the Promotion Period shall be automatically disqualified from participation. The Promoter is not liable for any lost, delayed or misdirected entry.

C. HOW TO PARTICIPATE 

1. To participate in the Promotion:
Participants must buy any of the following specially marked participating Coca‑Cola products “Participating Products” for a chance to win prizes: Coca‑Cola Original Taste (190 ML, 250ML, 290 ML, 500 ML), Coca- Cola Zero Sugar (190 ML, 250ML, 500 ML), Royal Orange (190 ML, 250 ML, 290 ML, 500 ML), Royal Lemon (190 ML, 250 ML, 290 ML), Sprite (190 ML, 290 ML, 500 ML) 

  • Participants must type in the 10-digit alphanumeric code found at the back of the label of specially marked Coca‑Cola K-Popromo Participating Products and send the code to Coca‑Cola Philippines’ Facebook Messenger account. 

2. Each entry will stand a chance to win daily prize (“Daily Prize”), a weekly prize (“Weekly Prize”) in the respective weekly draw (“Weekly Draw”), or the epic prize (“Epic Prize”) in the epic prize draw. 

D. HOW TO REGISTER: 

1. Participants must access the Coca‑Cola Philippines Messenger account. First time participants will be prompted to register and agree to the Coca‑Cola K-Popromo Promo Terms and Conditions and Privacy Policy. Participants should ensure that the registration and contact details they provide are accurate and updated. Promoter will not be responsible for ineligibility of participant arising from inaccurate or incomplete information or the inability to contact participants who are potential winners if their registration details are incorrect or not checked.

2. A participant’s personal information, made available on their Facebook account and their registration details, will be kept confidential by the Promoter and will be used for purposes of communication, marketing and advertising related to this promotion and other purposes disclosed and authorized in the Privacy Policy. 

3. Standard data rates for the use of Facebook and FB Messenger apply. 

E. HOW TO WIN

1. Participants type in the 10-Digit alphanumeric code found at the back of the label of Coca‑Cola K-Popromo Participating Products and enter it in the Coca‑Cola Philippines FB Messenger 

2. Upon typing the code found on pack, participants will be included in the promo raffle draw for a chance to win various prizes: DAILY PRIZES (mobile load, Spotify Premium vouchers, and fast food discounts); WEEKLY PRIZES (Gcash Cash prizes and concert tickets in the Philippines); and EPIC KPOP TRIP PRIZE (a Fully paid KPOP Tour in Seoul, South Korea). Specifics on prizes can be found in PRIZES and REDEMPTION portion. 

3. Each participant must have a valid Facebook account. 

F. PRIZES

1. The Daily Prizes, Weekly Prizes and the Epic Prize (collectively, “Prizes” or a “Prize”) are as follows: 

2. Winners of daily prizes are to be determined randomly and automatically via a designated system software. 

3. Winners of the DAILY PRIZES will be provided a winning code that they can use to claim their prizes though our promotion partners as instructed through our official Coca‑Cola Facebook Messenger chatbot. 

4. Weekly and epic raffle prize winners will be determined via raffle draws conducted on the following days and witnessed by FDA representatives: 

5. The number and types of prizes that will be awarded in this Promotion will not exceed those as stated in paragraph D (1). By participating in this Promotion, you acknowledge and agree that in no event will more that the stated number of prizes be awarded.

6. Winners of the Weekly Prizes of Php 10,000 GCash will be contacted by an official Coca‑Cola representative via FB Messenger, Phone Call, and/or SMS for proper validation.

7. Save where a prize or prize category comprises solely of cash, the Promoter reserves the right to substitute any Prize or elements of Prizes with alternatives of equal or greater value.

8. Daily and Weekly Prizes are awarded on an ‘as-is’ basis and are not transferable, negotiable, refundable or exchangeable. Non-cash prizes cannot be taken in cash. The Promoter reserves the right not to award any prize or part thereof to any person who, for any reason whatsoever, fails to meet any stipulated requirement in order to claim a Prize.

9. The Promoter reserves the right to substitute any winner subsequently found to be disqualified, for any reason whatsoever, with an alternative winner. 

10. A participant who is a potential winner but fails to respond to a verification request or fails to provide the necessary and adequate documents and information for verification within 48 hours from being contacted by Promoter’s representatives shall be considered as disqualified and will be replaced with an alternative winner. 

11. All Weekly Prizes must be claimed within 60 days from the winners’ announcement date. Prizes not claimed within the stipulated date will be forfeited by Promoter. 

12. Potential winners of the Epic KPop Trip will be contacted separately either via FB Messenger, Phone Call, SMS and/or email by an official representative of Promoter for verification and obtaining of required verification document and to get their contact details. Once verified, the winners will be announced. Winner and his/her companion are solely responsible for obtaining their own passports, VISAs and other necessary personal documents for the trip. The Epic KPop Trip in Seoul, South Korea prize consists of 2 economy airline ticket to Seoul, South Korea, 4 nights 5 days hotel accommodation at a hotel selected by the sponsor with 3 meals per day and snacks, and travel insurance, for 2 persons. The tour schedule is on September 26 to 30, 2024. 

a. The Epic KPop Trip is transferrable and cannot be converted to cash. The elements of this prize cannot be split, delayed, postponed nor converted into cash on a per element basis. Transfer should be done with 14 days after the announcement of winners before the schedule trip otherwise winning will be forfeited. 

b. Should the grand prize winner decided to transfer the winning, he/she must execute a notarized transfer document to his/her chosen recipient and a quit claim to the grand prize. 

c. Same set of Epic KPop Trip -- the EPIC KPOP TOUR in SEOUL prize consists of 2 economy airline ticket to Seoul Korea, 4 nights 5 days hotel accommodation at a hotel selected by the sponsor with 3 meals per day and snacks for 2 persons, and travel insurance – shall be transferred completely to the recipient. Consequently, the recipient and his/her 1 companion are solely responsible for obtaining their own passports, VISAs and other necessary personal documents for the trip. 

13. The Prize tax, if applicable, will be shouldered by the Promoter. The Promoter shall not be liable for warranties, maintenance, other taxes or any additional costs of the Prizes. 

G. VERIFICATION 

1. Codes presented are subject to verification. Any code that is illegible, mutilated, altered, duplicated, tampered with, not obtained legitimately, contains printing typographical, mechanical or other errors or the codes are unclear or does not contain a security or other required identification is invalid. 

2. If, for any reason, an entry is confirmed to have been erroneously deleted, lost or otherwise destroyed, corrupted or for any other reason not accepted as an valid entry, the Participant’s sole remedy is to enter this Promotion again using a different entry (if the Promotion has closed, then the said Participant shall have no other remedy apart from the possibility of entering a future promotion of the Promoter, with the understanding that there is no guarantee of any such future promotion).

3. The system will suspend Participant until 11:59 pm of the next day if Participant makes ten (10) invalid entries (ie. sends used or invalid codes) in a day. A mobile number that accumulates three (3) daily suspensions throughout the promo duration will be permanently suspended from the Promotion. 

4. Winner is responsible for the confidentiality of his/her code to ensure that such codes are not known by and used by others. Once a winning code is used, it cannot be used again. The one who first inputs and claims/uses the winning code will be considered as the authorized claimant of the winning code. 

5. The use of any voting software or any other mechanical or electronic means that allows an individual to automatically send codes repeatedly is prohibited and will render all codes submitted by that individual participant invalid. The Promoter shall be at the liberty to take action as may be available under the law against on such participant. 

6. The Promoter’s decision on all matters regarding to the Promotion including awarding of Prizes is final, conclusive and binding. 

H. OTHER CONDITIONS: 

1. Promoter has the sole discretion to disqualify and delete any entry containing a photograph or screenshot Promoter determines to be obscene, profane, lewd, defamatory, threatening, harassing, libelous, deceptive, invasive of another’s privacy, offensive or inappropriate in any manner whatsoever. 

2. If, for any reason, the Promotion is not capable of running as planned, Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the promo and/or proceed with the promo, including the selection of winners in a manner that it deems fair and reasonable, subject to applicable rules of and approval by the FDA. 

3. All promotional materials, including details on How to Participate and Prizes form part of these Terms and Conditions. In the event of any inconsistency between these Terms and Conditions with any advertising, promotional or publicity materials in relation to or in connection with the Promotion, these Terms and Conditions shall prevail. 

4. Personal information (including images) collected or received from you may be used by the Promoter for the purposes of administering and promoting the Promotion, including but not limited to conducting background check on your identity, verifying your eligibility to participate and receive a Prize, and publicizing winners’ announcement. By participating in the Promotion, you explicitly allow the Promoter to contact you via the particulars provided for such purposes. 

5. In no event will the Promoter or any of their respective Affiliates be responsible or liable for any damages or losses of any kind, including but not limited to direct, indirect, incidental, consequential, special or punitive damages arising out of your acceptance of a Prize, the use of a Prize, your entry into the Promotion, or your participation in any Prize-related activity. By entering into the Promotion, you hereby release and agree to hold harmless the Promoter and their respective Affiliates from and against any and all rights, demands, claims, causes of action, losses, damages, costs and expenses whatsoever that you may have, or which may arise, whether in whole or in part, and whether directly or indirectly. 

6. Notwithstanding any of the foregoing, the Promoter reserves the right to amend, add, replace, vary and/or modify these Term and Conditions without giving prior notice. Entry into this Promotion confirms acceptance of these Terms and Conditions and any amendments, additions, replacements, variations and modifications hereto, which shall be final and binding in all respects. 

7. If any term or part thereof is rendered void, illegal or unenforceable by any legislation to which it is subject, it shall be rendered void, illegal or unenforceable to that extent and it shall in no way affect or prejudice the enforceability of the remainder of such term or other terms of this Promotion. 

8. Promotion and the Terms and Conditions shall be construed under and governed by the laws of the Philippines. The parties hereby submit to the exclusive jurisdiction of the Courts of Taguig City, Philippines.
