FANTA HELP WANTA’D CONTEST OFFICIAL RULES
Submitting an entry constitutes your full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor and judges, which shall be final and binding on all matters relating to the Contest.
1. Eligibility: The Fanta Help Wanta’d Contest (the “Contest”) is open only to legal residents of the 50 U.S. and D.C. who are 16 years of age or older as of date of entry and who have their own free TikTok account (“Your TikTok Account”) with a public setting as of the date of entry and throughout the entire Contest Period (“Entrant”). Any Entrant who is under the legal age of majority in their state/territory of residence (a “Minor”) must have the consent and permission of their parent or legal guardian to enter. Employees of The Coca‑Cola Company (the “Sponsor”), Coca‑Cola bottlers, Don Jagoda Associates, Inc. (“Administrator”), and their respective subsidiaries, parent, divisions, franchisees, promotional partners, agencies, affiliates, advertising and promotion agencies (collectively, the “Released Contest Parties”) as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee, are not eligible to participate. This Contest is subject to all applicable federal, state, and local laws and regulations and is void where prohibited by law. Participation constitutes Entrant’s (and their parent/legal guardian on their behalf if the Entrant is a Minor) full and unconditional agreement to these Official Rules.
2. Contest Timing: The Contest begins 11:00 am Eastern Time (“ET”) on June 3, 2024 and ends 11:59 pm ET on June 14, 2024 (the “Contest Period”).
3. How to Enter: There is NO PURCHASE NECESSARY to participate in the Contest. A purchase does not increase your chances of winning.
During the Contest Period, go to the Promotion Website. Follow the links to learn about the Contest and submit your date of birth to confirm eligibility and move to the next step. Next, initiate a conversation with the chatbot, respond to the chatbot questions, and submit Your TikTok Account Handle (the “Evaluation”). Next, follow the instructions to log into or create a Coca‑Cola Website account (“Account”). After logging in, you will receive an on-screen message and email and be prompted to follow the instructions to post a video on Your TikTok Account showing how you sip or pretend to sip Fanta and why you would be the best “Guru of Deliciousness” (full Judging Criteria listed in section 4 below). Post using the hashtag #WantaGigContest in the video caption, tag @Fanta, and follow @Fanta on TikTok (the “Audition”). You must successfully complete the Evaluation, log into or create your Account and complete the Audition to receive one (1) Entry (the “Entry”) into the Contest. You must use the hashtag, follow the Fanta TikTok account and abide by all TikTok post requirements for your Audition to be eligible. Any sound must be audible in the Entry. Entries must prominently include the Entrant. Entrants must have a public TikTok account to enter. Potential winners may be required to show proof of being the authorized account holder of the TikTok account associated with the Entry. Limit one (1) Entry per person/Account/TikTok account/email address. Any attempt by any Entrant to obtain more than one (1) Entry by using multiple/different Accounts, email addresses, TikTok handles, identities, registrations and logins, or any other methods will void such entries and that Entrant may be disqualified. Use of any automated or computer system to participate is prohibited and will result in disqualification. All Entries must be completed and submitted during the Contest Period (and include all components mentioned above) to be eligible for judging. In the event of a dispute as to the identity of an Entrant, the authorized account holder of both the TikTok account submitted at the time of Entry and the Account will be deemed to be the Entrant. "Authorized account holder" of a TikTok account/Account is defined as the person who is responsible for joining the Site and the Coca‑Cola Website and who manages the e-mail address associated with the TikTok account/Account. Any Entry must be complete to be eligible. Sponsor has the sole discretion to determine whether an Audition qualifies as an Entry. Any Entry not in compliance with the above, and which does not meet the requirements of these Official Rules, may be disqualified. Participation is subject to disqualification of all Entries, if multiple TikTok, Accounts, or email accounts are used by the same person. Internet/phone access and usage/data charges imposed by Entrants’ online/mobile service may apply.
Please make sure to note the following regarding your Evaluation, Audition, and Entry:
- You must be the only person completing and featured in your Evaluation, Audition, and Entry.
- Evaluations must be completed in English.
- Drinking Fanta in your Audition is not required, but it is highly encouraged.
- Auditions must be in English and no longer than 60 seconds.
- Only the first Audition submitted by Entrant during the Contest Period will be considered for the Entry.
- Auditions may include music but the music must be owned by you, you have obtained the rights to its usage or it’s royalty-free.
- Auditions may include animals that you own or inanimate objects in addition to yourself.
- Clothing worn in the Audition should not contain any visible logos (other than those owned by The Coca‑Cola Company), drawings, cartoons, phrases, trademarks or other third-party materials other than The Coca‑Cola Company.
- Auditions must not include any representation of celebrities, athletes, musicians, or any other public or private figure, include any anti-social, political or religious groups, any commercial solicitation or promotional materials or name, address, phone number, or URL address.
- Auditions must not contain advertisements, personal solicitations or commercial solicitations.
- Auditions may not be owned, taken or edited by a professional photographer/videographer.
- Auditions must not feature beer, distilled spirits (i.e., hard liquor, malt beverages), tobacco products (including cigarettes, cigars, pipe tobacco, chewing tobacco and snuff), fireworks, firearms and ammunitions, prescription drugs, illegal drugs and related drug paraphernalia, nutritional supplements, lotteries and gambling.
- Entries must not feature any branded beverages other than Fanta.
- Entries must not contain content that is known by you to be false, inaccurate or misleading.
- Any Entries deemed inappropriate or unsuitable, in Sponsor’s sole discretion, will be disqualified. Entry must not contain material that is inappropriate, indecent (including but not limited to nudity, or pornography), profane, obscene, hateful, tortuous, defamatory, slanderous or libelous (including words or symbols that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation, or socioeconomic group).
- Entries must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.
- Entries must not contain criminal or tortuous activity, including but not limited to child pornography, fraud, trafficking of obscene material, drug dealing, drug use, or gambling. Entry must not contain material that is unlawful, in violation of or contrary to all applicable local, state, federal, or international laws and regulations.
- Any Entry or portion thereof that is, in Sponsor’s sole discretion, obscene, profane, lewd, defamatory, contains any third-party materials, other than The Coca‑Cola Company related materials, or otherwise violates or infringes (or may infringe) any copyright (including music recordings), trademark, logo, mark that identifies a brand or other proprietary right of any person living or deceased (including but not limited to rights of privacy or publicity or portrayal in a false light) or entity or make reference to any commercial/corporate advertising (including but not limited to corporate logos, brand names, slogans, political, or religious statements), or is otherwise objectionable, will not be considered and will disqualify the Entrant.
- Entries must not contain viruses, Trojan horses, worms, bots, spyware or any other computer code that is intended to damage, interfere with, or surreptitiously intercept or expropriate any system, data or information.
- Entrants and all submitted Entries must be in keeping with Sponsor's image/The Coca‑Cola Company or brand image as determined by Sponsor, in its sole discretion, or Entry will be disqualified from the Contest. The Entry must not disparage persons or organizations associated with Sponsor.
- Entrants and all submitted Entries may not negatively reference any of The Coca‑Cola Company’s competitors, in Sponsor’s sole discretion.
All Entries submitted become the property of Sponsor upon submission and will not be returned. Each Entrant (and by winning, each winner) and the parent or legal guardian of any Minor Entrant/winner grants to Sponsor a worldwide, royalty-free, perpetual, non-exclusive right and license to copy, distribute, and display each submitted Entry (and Content, defined below), in any media, and with right to use, copy, modify, edit, and create derivative works there from, and agrees to execute documents confirming such right and license (as further defined in Section 9 below) at Sponsor’s reasonable request. Any Entry deemed inappropriate or unsuitable, in Sponsor’s sole discretion, will be disqualified. By entering, you or your parent or legal guardian if you are a Minor, understand that your Entry (or portion thereof) may be posted online, in Sponsor’s sole discretion, to be viewed by members of the general public. Entrants may not copy or otherwise plagiarize any portion of the Entry from any source. No information regarding Entries or judging, other than as otherwise set forth in these Official Rules or on the website listed above, will be disclosed. All eligible Entries must be received during the Contest Period.
4. Judging: Within eight (8) days after the Contest Period, all Entries received during the entire Contest Period will be judged and scored by Sponsor-selected Judges (“Judges”), to determine three (3) winners based on the following criteria:
- Appropriateness to the public image of the Sponsor – 40% - Does the video meet the Fanta brand mission and values? Does the video convey an optimistic and enthusiastic tone? Does the video prominently feature Fanta products? Does the video utilize the Fanta jingle sound on TikTok? Is the person drinking or pretending to drink Fanta?
- Originality/Creativity – 30% - How creative, original and interesting is the video Audition? Does the video appeal to Fanta’s target market?
- Quality – 30% - Is the video of good quality (i.e., good lighting, not pixelated)? Does the video have appropriate, audible sound?
The three (3) Entries that receive the highest scores from the Judges will be deemed the potential Grand Prize winners, subject to verification. In the event of a tie, tied Entries will be re-judged by the Judges based 50% on Originality/Creativity and 50% on Appropriateness to the public image of the Sponsor. Sponsor/Judges’ decisions are final with respect to all matters relating to the judging. By participating, Entrants (and parent or legal guardians for any Minor Entrant) agree to the decisions of the Judges/Administrator, which shall be final and binding in all respects. No information regarding Entries or judging will be disclosed to any third party not involved in the conduct of the Contest.
5. Winner Notification: The potential Grand Prize winners (or their parent/legal guardian if they are a Minor) will be required to sign and return a Declaration of Eligibility and Liability Release and, except where prohibited, publicity release and assignment of rights (“Declaration”) along with a non-disclosure agreement (“NDA”), within forty-eight (48) hours of notification in order to be confirmed as a Grand Prize winner. If a potential Grand Prize winner fails to return the completed Declaration and NDA within forty-eight (48) hours or Declaration/NDA is returned as undeliverable, said Entrant shall be deemed to be ineligible, the prize will be forfeited and an alternate potential winner may be determined, time permitting. Declarations/NDAs will be sent via email. If an Entrant is disqualified for one of the reasons mentioned above and an alternate is determined, the alternate must complete and return the required documents in the timeframe specified. Up to three (3) alternates may be determined, time permitting. Grand Prize winners may be subject to a background check at the sole discretion of Sponsor. Based on the results of the background check, at the discretion of the Sponsor, a winner may be disqualified: (a) if charged with or convicted of a felony or misdemeanor; (b) if Sponsor determines, in its sole discretion, that winner may reflect unfavorably on the Contest or Sponsor; (c) if winner is not eligible to receive the prize based on the eligibility requirements set forth in these Official Rules. In such an event, an alternate winner will be determined and notified as stated above.
6. Prize and Actual Retail Value (“ARV”): Three (3) Grand Prizes: A gig as a “Guru of Deliciousness” from approximately July 1, 2024 – August 4, 2024 (subject to change, in Sponsor’s sole discretion) (“Gig”). Prize includes the following:
- A successful gig payout of $10,000, awarded as a $2,000 digital prize payment issued weekly for five (5) weeks after Content (defined below) is completed and submitted by the winner.
- A 3-day/2-night trip to Atlanta, GA to visit Coca‑Cola’s headquarters for the winner and one (1) travel companion (“Atlanta Trip”). See section 7 for details if winner is a Minor.
- Two (2) local excursions of winner’s choice (as mutually agreed upon by winner and Sponsor). Details will be provided at time of usage and must be redeemed as specified.
- A 3-day/2-night theme park excursion for winner and three (3) travel companions (“Theme Park Trip”).
- A check for $6,700, awarded to the winner only, to help defray taxes.
- Additional extras, which may include, but are not limited to: gift cards, Fanta product, clothing & accessories, meals, and services.
Total Maximum ARV: $30,000 each.
The Atlanta Trip package includes round trip economy air transportation for winner and one (1) travel companion from a major airport near winner’s home (determined by Sponsor in its sole discretion) to Atlanta, GA, two (2) nights’ hotel accommodations in a Sponsor-specified hotel for winner and travel companion. The Theme Park Trip package includes round trip economy air transportation for winner and up to three (3) travel companion from a major airport near winner’s home (determined by Sponsor in its sole discretion) to the airport nearest the selected theme park, two (2) nights’ hotel accommodations in a Sponsor-specified hotel for winner and up to three (3) travel companions, and up to four (4) 3-day park tickets to a theme park of winner’s choice, as mutually agreed upon.
As part of Prize acceptance, winners agree to the terms and conditions of the agreement for the Gig, as provided by Sponsor at time of prize award. All details of the Gig are established at Sponsor’s sole discretion and winner agrees to follow all guidelines in order to receive the complete prize. Some responsibilities of the Gig are, but are not limited, to: publishing posts, other written works, video or audio recordings, images and/or photographs, or other materials on TikTok (collectively, the “Content”) for a minimum of four (4) posts per week for a total of five (5) weeks during the Gig. All Content will be reviewed by one or more entities as determined by Sponsor prior to being published, and the winner may be provided more specific critiques prior to next submission of Content. All Content requested by Sponsor must be provided in the timeframe specified otherwise part or all of the Gig payout may not be awarded. Any Content uploaded/submitted by winners during the Gig will become Sponsor's sole property and Sponsor may edit or use such Content as they see fit in marketing and promotional purposes. All Content is subject to review and approval by the Sponsor. The Grand Prize does not constitute employment with Fanta or any of its affiliates in any form—it is awarded solely based on the Judging Criteria outlined in section 4. Recipients of the Grand Prize will not be considered employees of The Coca‑Cola Company and will not receive any employee compensation, benefits, or status.
7. Trip and Excursion Details: All trips and excursions must be taken on dates specified by the Sponsor (as they correlate to any prize events) or prize (or that event/excursion) will be forfeited. If a prize winner elects to partake in the Atlanta Trip or Theme Park Trip with no travel companion(s), that portion of the prize will be awarded to that winner only and any participating travel companion part and any remainder of the prize will be forfeited and shall not be subject to further or alternative compensation. Airline carrier's regulations and conditions apply. Trips may not be combined with any other offer and travel may not qualify for frequent flyer miles. The winners and their respective travel companion, as applicable, must travel together on the same itinerary. All travelers must have valid travel documents prior to departure (i.e., REAL ID, passport or other TSA-approved ID; visit www.tsa.gov for a list of TSA-approved IDs). Travel companions (or winner on behalf of minor travel companion) must complete a Release of Liability prior to departure. A minor going on the trip as the travel companion of a prize winner must be accompanied by a parent or legal guardian at all times (i.e., the prize winner). If the winner is a Minor, they must be accompanied by a parent/legal guardian. The parent or legal guardian would also be required to accompany the Minor on all other Prize excursions/events. All other expenses and costs, not expressly listed above, including, but not limited to, taxes, insurance, telephone charges, room service and laundry services, personal expenses, gratuities, entertainment, transfers, incidental charges, or any other items not specifically described in these Official Rules, any transportation not mentioned within the above prize description and all expenses for any of the foregoing are the sole responsibility of each prize winner (or the parent or legal guardian). If any prize (or portion of prize) becomes unavailable, Sponsor will substitute the prize of equal or greater retail value. No transfer, cash or other substitution of the prize is permitted except Sponsor may substitute prize in whole or in part for one of comparable or greater retail value for any reason. In the event a prize winner and/or travel companion(s) engages in behavior during travel that (as determined by Sponsor in its sole discretion) is obnoxious or threatening, illegal, or that is intended to threaten or harass any other person, or that in any way disparages or adversely affects the reputation, image, and/or customer goodwill of Sponsor, or any of Sponsor’s services, products, trademarks, service marks, or logos, Sponsor reserves the right to terminate their travel early, eject them from any event/excursion and send the prize winner and travel companion(s) home with no obligations or compensation to winner. Resale of any prize component is prohibited. Winners and travel companions must follow any applicable COVID protocols in place at time of travel. Prizes are non-transferable, non-assignable, and no substitution or cash redemption is allowed, except that Sponsor reserves the right to amend the responsibilities of the Gig in their sole discretion. All Prize components and details are in the Sponsor’s sole discretion. If the winner does not post Content (as described above) as required, Sponsor reserves the right to withhold any future weekly $2,000 digital prize payment. Limit one (1) Prize per Entrant/household. All federal, state, and local taxes are solely the responsibility of each winner (or the parent/guardian if winner is a Minor). Winners (or their parent/guardian if winner is a Minor) will be issued a 1099 tax form for the actual retail value of prize awarded.
8. General Rules: By participating in the Contest, Entrants (or their parent/legal guardian if the Entrant is a Minor) agree to be bound by the Official Rules and the decisions of the Sponsor. Administrator’s/Judges’ decisions are final on all matters relating to the Contest. The Sponsor and its agencies are not responsible for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized in the Contest or by any human error which may occur in the Contest. Sponsor reserves the right to cancel the Contest if any aspect of the Contest becomes technically corrupted, and determine the winners from Entries received prior to cancellation. The Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the Entry process or the operation of the Contest or Website; violates the Official Rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. The Sponsor and its agencies and each party’s respective affiliates, officers, directors, agents, and employees will have no liability or responsibility for any claim arising in connection with participation in the Contest or the awarding of prizes. Winners (or parent/legal guardian for any Minor winners) assume all liability for any injury or damage caused, or claimed to be caused, by participation in the Contest, creation or submission of Content or use or redemption of any prize or prize component or travel thereto.
9. Release: By submitting an Entry or winning a prize and creating and submitting any Content, you (or your parent/legal guardian if you are a Minor) hereby grant the Sponsor, its affiliates, subsidiaries, assigns, licensees, and legal representatives the irrevocable, perpetual, worldwide right to use, reproduce, edit, market, store, distribute, have distributed, publicly and privately display, communicate, publicly and privately perform, transmit, have transmitted, create derivative works based upon, and promote the Entry/Content (as such may be edited and modified by the Sponsor in its discretion) for editorial, commercial, promotional and all other purposes (including posting on any websites). In addition, you (or your parent/legal guardian if you are a Minor) hereby assign to the Sponsor all rights, titles, and interests that you may be deemed to have in any reproduction, product, or derivative work using or incorporating the Entry/Content. You (or your parent/legal guardian if you are a Minor) represent and warrant that: (i) the Entry/Content does not and shall not infringe on any copyright or trademark or any other third-party right nor violate any applicable law or regulation, (ii) you have the right to grant any and all necessary rights and licenses provided herein, including without limitation, all necessary copyright, trademark and other related rights to the entry, free and clear of all claims and encumbrances without violating the rights of any person or entity, including any right to privacy or publicity. You (or your parent/legal guardian if you are a Minor) waive any right to inspect or approve uses of the Entry/Content or to be compensated for any such uses. You (or your parent/legal guardian if you are a Minor) hereby release Sponsor, its affiliates, officers, directors, agents, co-branders or other partners, and any of its employees (collectively, the "Contest Parties"), harmless from any and all claims, damages, expenses, costs (including reasonable attorneys' fees) and liabilities (including settlements), brought or asserted by any third party against any of the Contest Parties due to or arising out of your participation in the Contest, or use of your name, likeness, Entry/Content and/or voice, or any other rights granted to Sponsor, including any claims for including but not limited to trademark, copyright, or other intellectual property rights, right of publicity, right of privacy or defamation. You (or your parent/legal guardian if you are a Minor) further agree to release and indemnify and hold harmless Contest Parties from any and all claims that any commercial, advertising, presentation, web content or any other material subsequently produced, presented, and/or prepared by or on behalf of Contest Parties infringes on your rights as contained in the Entry/Content. Sponsor and their respective affiliates, officers, directors, agents, and employees will have no liability or responsibility for any claim arising in connection with participation in this Contest or any prize awarded. You (or your parent/legal guardian if you are a Minor) agree that you shall have no right of approval, no claim to compensation or benefit, and no claim (including, without limitation, claims based upon invasion of privacy, copyright infringement, defamation, or right or publicity) arising out of any use or any editing, distortion, alteration, optical illusion, or use in partial or composite form, whether or not intentional. Your participation is completely voluntary. You (or your parent/legal guardian if you are a Minor) acknowledge that your participation may present certain risks, and you hereby assume any and all risks, known or unknown, associated with your participation in the Contest/winning a prize/creation or submission of Content/travel. The Contest and the Official Rules shall be exclusively governed by and construed in accordance with the laws of the state of Georgia, without regard to conflicts of law provisions. Entrants (or parent/legal guardians if a Minor) submit to exclusive personal jurisdiction in Georgia and agree that any dispute shall be brought in the state and federal courts in Georgia.
10. Privacy Policy: Information collected by Sponsor in connection with this Contest may be used by Sponsor and shared with third parties involved in administration of the Contest in accordance with the Sponsor’s online Privacy Policy posted at https://www.coca-cola.com/us/en/legal/privacy-policy. The Entrant (and their parent/legal guardian on the Entrant’s behalf if the Entrant is a Minor) agrees to the collection, processing and storage of his/her personal data by Sponsor for the purposes of the Contest.
