Terms and Conditions 

Promoter

Coca‑Cola South Pacific Pty Ltd (ABN 50 003 029 794), Level 9, 40 Mount Street, North Sydney, NSW 2060, Australia.
 

Competition Period

12.01am AEDT 01/01/2025 to 11.59pm AEDT 10/03/2025.
 

Who can enter?

Only Australian residents who:

(a) are aged 15 or over; and

(b) can take the major prize between 10 & 15 April 2025 in the Palm Springs, United States of America or 17 & 22 July in Brussels, Belgium (inclusive) (depending on the major prize won) and have a current and valid passport that meets the validity requirements as applicable for the destination country.

If you are under 18, you must get approval from your parent/guardian before you enter and if you will be under 18 on the date the prize is awarded, it will be awarded to your parent or guardian. If you are under 18 on the date Major Prize 2 or 3 (to Coachella, in Palm Springs, USA) is awarded, your parent or guardian must be your companion.  By approving your participation or by accepting any prize on your behalf, your parent or guardian accepts these conditions. Please ensure the Ts&Cs are provided to the parent or guardian.

You must be aged 18 or over to take Major Prize 1 (to Tomorrowland in Brussels, Belgium). If you are aged under 18 on the date you win Major Prize 1, you will instead be awarded an alternative major prize of equal or greater value (see “What can I win?” section below).
 

Who can't enter?

Directors, officers, management and employees (and their immediate families) of:

(a) the Promoter; and

(b) the agencies, companies or participating premises associated with this competition.
 

Where will the competition run?

The competition will run in participating liquor licensed venues and restaurants (Venues), outlets and stores (Stores) and Cinemas (Cinemas) which are stocking specially marked products and are displaying promotional material in Australia.

The Venues/Stores include the online websites for those Venues/Stores and third party delivery services.

• Coca‑Cola Classic, Coca‑Cola Zero Sugar, Diet Coke, Fanta, Raspberry Fanta, Sprite. 

In Event cinemas, any of the following specially marked small size promotional cups: 

• Coca‑Cola Classic, Coca‑Cola Zero Sugar, Diet Coke, Fanta, Lift, Sprite.

For the avoidance of doubt, Frozen Coca‑Cola products are excluded from this Promotion. 
 

Entry instructions

In-store purchase

To enter, you must:

(c) make a Qualifying Purchase from a Store;

(d) then, during the Competition Period: 

(i) locate the unique code/s on the Qualifying Purchase product; and

(ii) scan the QR code or visit the Website, locate the entry page and fill out and submit the online entry form to register an account, including by providing the unique code, and providing all other requested information to see if you have won or provisionally won an instant win prize and receive an entry into the major prize draw.

If your Qualifying Purchase is from a Store that is:

• a Woolworths or Woolworths Metro Store or via Woolworths Online at www.woolworths.com.au or a Big W store or Big W online at www.bigw.com.au (a Woolworths Store) (as submitted in your entry form), you will also receive one entry into the Woolworths Exclusive Draw for a chance to win a Woolworths Exclusive Prize; 
• a Pizza Hut store or Online at www.pizzahut.com.au (a Pizza Hut Store) (as submitted in your entry form), you will also receive one entry into the Pizza Hut Exclusive Draw for a chance to win a Pizza Hut Exclusive Prize; or 
• a 7/11 Store (as submitted in your entry form), you will also receive one entry into the 7/11 Exclusive Draw for a chance to win a 7/11 Exclusive Prize. 

Venues (Liquor licensed venue and restaurants)

To enter, you must, during the Competition Period:

(a) make a Qualifying Purchase from a Venue;

(b) receive a scratch card from that Venue (subject to stocks remaining);

(c) then during the Competition Period:

(i) scratch the panels on the scratch card to reveal the unique code; and

(ii) scan the QR code or visit the Website, locate the entry page and fill out and submit the online entry form to register an account, including by providing the unique code, and providing all other requested information to see if you have won or provisionally won an instant win prize and receive an entry into the major prize draw.

Cinema purchase

To enter, you must:

(a) make a Qualifying Purchase from a Cinema;

(b) then, during the Competiton Period: 

(i) scan the QR code or visit the Website, locate the entry page and fill out and submit the online entry form to register an account, including by providing all other requested information to see if you have won or provisionally won an instant win prize and receive an entry into the major prize draw.

The Promoter is not responsible if your mobile device/desktop is not sufficiently capable for the purpose of submitting an entry. 
 

How many winners will there be and how will they be chosen?

There will be up to 6,757 winners determined in respect of this competition (3 major prize winners, 5,450 instant prize winners, 1,191 Woolworths Exclusive Prize winners, 10 Pizza Hut Exclusive Prize winners and 1 7/11 Exclusive Prize winner).

Instant win prizes

There are up to 5,450 instant win prizes to be awarded based on pre-determined times during the Competition Period selected by a computerised random system at The Coca‑Cola Company, 1 Coca Cola Pl SE, Atlanta, GA 30313, United States of America (The Coca‑Cola Company).  
 

Draws (for major prizes and exclusive prizes)

There will be 4 draws conducted (1 major draw, 1 Woolworths Exclusive Draw, 1 Pizza Hut Exclusive Draw  and 1 7/11 Exclusive Draw).   

All draws will be held at Handling Matters, Unit 40/1-5 Thew Parade, Cromer NSW 2099, commencing at 12pm AEDT on 13/03/2025. 

• Major Draw
  The first valid entry drawn randomly from the entries received during the Competition Period (including any instant win prize winning entries) will win Major Prize 1, the second valid entry drawn randomly will win Major Prize 2 and the third valid entry drawn randomly will win Major Prize 3.

There is a maximum of one major prize per person (except for SA residents). 

• Woolworths Exclusive Draw:
  The first 1,191 valid entries drawn randomly from all the entries received during the Competition Period where the Qualifying Purchase was made from a Woolworths Store (including any instant win prize and/or major prize winning entries) will each win a Woolworths Exclusive Prize.
• Pizza Hut Exclusive Draw:
  The first 10 valid entries drawn randomly all the entries received during the Competition Period where the Qualifying Purchase was made from a Pizza Hut Store (including any instant win prize and/or major prize winning entries) will each win a Pizza Hut Exclusive Prize.
• 7/11 Exclusive Draw:
  The first  valid entry drawn randomly from all the entries received during the Competition Period where the Qualifying Purchase was made from a 7/11 Store (including any instant win prize and/or major prize winning entries) will win a 7/11 Exclusive Prize. 

The Promoter may draw additional reserve entries in a draw and record them in order, in case a winning entry/entrant is deemed invalid or a prize is unclaimed (Reserve Entrants). 
 

What can I win?

There are up 6,757 prizes available (5450 instant win prizes, 3 major prizes, 1,191 Woolworths Exclusive Prizes, 10Pizza Hut Exclusive Prizes and 1 7/11 Exclusive Prizes).

Instant win prizes

There are up to 5,450 instant win prizes to be awarded throughout the Competition Period, as follows:
 

Any ancillary costs associated with redeeming the Prezzee Music Swap Card are not included. Any unused balance of the Prezzee Music Swap Card will not be awarded as cash. Redemption of the Prezzee Music Swap Card is subject to any terms and conditions of the issuer including those specified on the Prezzee Music Swap Card. Any ancillary costs associated with redeeming the Digital Vault Pays-enabled Prepaid Mastercard ® are not included. The digital Vault Pays-enabled Prepaid Mastercard must be activated within 2 months of issue and is valid for 12 months after activation. At expiry of the Digital Vault Pays-enabled Mastercard any unused balance will be forfeited. Eligible Customers will not receive notice prior to expiry. Major Prize 1

The major prize is a trip for the winner and 1 adult companion to Tomorrowland  in Brussels, Belgium from 17-22 July 2025 valued at up to $18,575 (depending on the winner’s point of place of residence) and includes the following:

(a) return economy airfares (including airfare taxes) from your nearest Australian capital city to Antwerp Airport in Belgium and return transfers between Antwerp Airport and the accommodation; and 

(b) 5 night/s accommodation in Brussels in a minimum 4 star accommodation (twin room or similar) as determined by the Promoter; and 

(c) 2x tickets to Tomorrowland including transfers to and from the accommodation; and

(d) AUD$1,000 spending money awarded as bank transfer (to the winners nominated bank account) for the winner only.

You must be aged 18 or over to take Major Prize 1. If you are aged under 18 on the date you win Major Prize 1, you will instead be awarded an alternative prize of equal or greater value being a Free 2 Travel voucher. 
 

Major Prizes 2 & 3

Each winner for major prizes 2 & 3 will each be awarded a trip for the winner and 1 companion to Coachella in Palm Springs, USA from 10-15 April 2025 valued at up to $19,980 (depending on the winner’s point of place of residence) and includes the following:

(a) return economy airfares (including airfare taxes) from your nearest Australian capital city to Palm Springs, USA and return transfers between Palm Springs airport and the accommodation; 

(b) 5 nights accommodation in a minimum 4 star hotel in Palm Springs (twin room or similar, as determined by the Promoter); and 

(c) 2x Weekend 1 Coachella shuttle passes and tickets; and

(d) AUD$1,000 spending money for the winner awarded via bank transfer (to the winners nominated bank account).
 

Major prize 2 & 3 Conditions:

• Travel must be taken on the dates required by the Promoter to coincide with the Coachella 2025 at Palm Springs, USA event (taking place from April 11-13 2025). If the winner is unavailable or unwilling to travel on the date/s required by the Promoter to coincide with this event, they will forfeit their right to the prize and will not be awarded cash or any other alternative in lieu.
• Travel itinerary will be determined by the Promoter in its absolute discretion.
• Prize is subject to the standard terms and conditions of individual prize and service providers.
• The winner and his/her travel companion must depart from and return to the same departure point and travel together.
• If the winner is under 18 years of age at the start of the Promotion, their nominated travelling companion must be a parent or legal guardian who is 18 years of age or older.
• Subject to the terms and conditions of the participating prize provider(s), if for any reason the winner does not, once the prize has been booked, take the prize (or an element of the prize) at the time stipulated, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.
• The Coachella 2025 tickets are subject to the event venue and ticket terms and conditions, including any applicable age restrictions. The Promoter and event organisers hereby expressly reserve the right to eject any winner and/or his/her companion for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.
• The prize is subject to booking and flight availability.
• Frequent flyer points will not be awarded and do not form part of the prize.
• Spending money, meals, taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs, unless otherwise specified in the prize description, are not included.
• Each winner, or their respective travelling companion, must have a valid credit card, which is required for hotel expenses not covered under the Coachella Festival Experience.
• The winner and their travelling companion are responsible for meeting all travel and health requirements for any international travel. It is the responsibility of the winner and their travelling companion to check with all government health authorities regarding travel requirements and eligibility. Any fines, penalties, expenditure or inability to travel as a consequence of not meeting such requirements are the sole responsibility of the winner and their travelling companion.
• The Promoter makes no representation as to the safety, conditions or other issues that may exist at any of the destinations or events forming part of the prize. It is the sole responsibility of winner to check government advisories and/or conditions regarding the safety and situation of any such destinations.
• If the prize cannot be provided as intended due to any COVID 19 related restrictions or guidelines, the Promoter reserves the right to award an alternative prize in lieu, in accordance with clause 6 below of the Terms and Conditions.
• The winners will be required to sign a Participation Agreement in the form required by the Promoter, confirming acceptance of these Terms and Conditions of Entry; accepting the Terms and Conditions relating to the use and enjoyment of the Coachella Festival Experience; releasing the Promoter, and it’s officers, directors, shareholders, employees, advisors, assignees, agents, licensees, representatives, advertising and promotional agencies, to the extent permitted by law, from any and all liability in connection with this promotion and/or the Coachella Festival Experience.
• Taking the Coachella Festival Experience is also subject to any prevailing terms and conditions of any accommodation / transport / services / transfers / ticket providers, and in particular, of any health, behaviour, age and safety requirements. Any tickets or vouchers issues as part of the Coachella Festival Experience are subject to prevailing terms and conditions of use, are only valid for use within the stated duration on the tickets or vouchers issued, and are not replaceable if lost, stolen or damaged.

The major prizes are subject to any applicable law or guidelines including in relation to a pandemic, any travel/government restrictions/directives, border closures, health advice and the like.

By accepting or participating in any major prize, your companion accept these Terms and Conditions.  
 

Woolworths Exclusive Prizes

Only available to valid entrants who made a qualifying purchase at a Woolworths Store.

Any Woolworths Exclusive Prize that is unclaimed will be included in the relevant unclaimed prize draw.
 

Pizza Hut Exclusive Prizes

Only available to valid entrants who made a qualifying purchase at Pizza Hut.

Any Pizza Hut Exclusive Prize that is unclaimed will be included in the relevant unclaimed prize draw.
 

7/11 Exclusive Prizes

Only available to valid entrants who made a qualifying purchase at 7/11.

Any 7/11 Exclusive Prize that is unclaimed will be included in the relevant unclaimed prize draw.
 

Total prize pool

The instant win prize pool is up to $211,250

The major prize pool is up to $58,535

The Woolworths Exclusive Prize pool is $47,640

How many times can I enter?

You can enter up to 3 times per person, per day throughout the Competition Period provided you only enter once per Qualifying Purchase and per unique code.  Each entry must be submitted separately in accordance with these Terms and Conditions. 
 

How and when will the winner/s be informed?

Major & exclusive prize winners

Major & exclusive prize winners will be notified:

• by phone; and
• in writing (by email)

within 2 business days of determination. Major prize winners and Pizza Hut & 7/11 Exclusive Prize winners will have their name and state/territory of residence/postcode published on the Website on 17/03/2025 for a period of 28 days.

Instant win prizes

You will get a return online message acknowledging your entry and informing you if you have won or provisionally won a prize and if so, details on how to verify your entry and claim your prize.  If you win a physical instant win prize, you will be asked to provide your Australian postal address details   for that prize to be delivered to you. Prizes will only be delivered to addresses inside Australia. 
 

Proof of purchase

You must keep the following as proof of purchase for all entries:

• unique code/s.

If you don't produce the above proof of purchase for all entries when asked the Promoter may disqualify all of your entries and you will lose any right to a prize. 

If, in the Promoter's opinion based on the available information, you have shared any proof of purchase with another person, your entries will be invalid and you will lose any right to a prize. 
 

Unclaimed & Un-won prize/s

There are 2 different claim dates – as follows:

Prize claim date for major prizes 2 & 3 and 7/11 Exclusive prize: 5pm AEDT 17/03/2025.

Unclaimed and un-won prize determination (for major prizes 2 & 3 and 7/11 Exclusive prize): 12pm AEDT 18/03/2025 at the same location as the original draw.

If major prize 2 or 3 and/or the 7/11 Exclusive prize is un-won during the Competition Period or has not been accepted or claimed by 5pm AEDT 17/03/2025, or if after making all reasonable attempts, the Promoter can't contact a winner (or a winner does not contact the Promoter) by 5pm AEDT 17/03/2025, the relevant entry/ies will be discarded and the Promoter will re-award the relevant prize/s to Reserve Entrant/s and/or carry out an unclaimed and un-won prize draw at the date, time and place stated above. For clarity, if the Promoter conducts an unclaimed and un-won prize draw for a 7/11 Exclusive Prize, such draw will be conducted amongst valid entrants who made a Qualifying Purchase at a 7/11 Store during the Competition Period.  

Any such winner/s will be informed:

• by phone; and
• in writing (by email)

within 2 business days of determination. Any such major prize winners will also have their name and state/territory of residence/postcode published on the Website on 25/03/2025 for a period of 28 days

Prize claim date for Major prize 1, Woolworths Exclusive prize & Pizza Hut Exclusive prize: 5pm AEDT 27/03/2025.

Unclaimed and un-won prize determination (for major prize 1 & exclusive prizes): commencing at 12pm AEDT 28/03/2025 at the same location as the original draw.

If the major prize 1, Woolworths Exclusive prize or the Pizza Hut Exclusive prize is un-won during the Competition Period or has not been accepted or claimed by 5pm AEDT 27/03/2025 or if, after making all reasonable attempts, the Promoter can't contact a winner (or a winner does not contact the Promoter) by 5pm AEDT 27/03/2025, the relevant entry/ies will be discarded and the Promoter will re-award the relevant prize/s to Reserve Entrant/s and/or carry out an unclaimed and un-won prize draw at the date, time and place stated above to randomly distribute the prize/s in descending order of value amongst valid entrants who (if possible) have not already won an unclaimed or un-won prize. For clarity, if the Promoter conducts any unclaimed and un-won prize draws for any exclusive prizes, such draw/s will be conducted amongst valid entrants who qualify for that exclusive prize based on where their Qualifying Purchase was made. 

Any such winner/s will be informed:

• by phone; and
• in writing (by email)

within 5 business days of determination.  Any such major prize 1 winner, and Coles Exclusive Prize winners will also have their name and state/territory of residence/postcode published on the Website on 04/04/2025 for a period of 28 days.

Instant win prizes: There will be no unclaimed instant win prizes.  All digital instant win prizes will be automatically awarded to winners via email to the email address associated with their entry.  It is an entrant's responsibility to ensure that they enter their email address correctly.  If they fail to enter their email address correctly, the digital instant win prize will be forfeited. If any physical instant win prize remains unwon they will be foreited.

If any prize remains un-won at the end of this competition, or if a prize winner cannot be found, that information will be published on the Website on 02/05/2025.
 

Collection and use of your personal information

If you are a winner, you and (if applicable) your companion must take part in all publicity, photography and other promotional activity as the Promoter requires, without any compensation.  You/your companion consent to the Promoter using your names and images in any promotional or advertising activity.

The Promoter may collect your/your companion’s personal information directly or through the Promoter's agents or contractors.  The Promoter will use your/your companion’s personal information to conduct and manage the promotion. The Promoter may disclose your/your companion’s personal information to the Promoter's related companies, agents and contractors to assist in conducting this promotion, communicating with you/your companion or storing data. This may include disclosures to organisations outside Australia including in places such as New Zealand and Singapore.

If you have marked the “opt-in” box on the entry form, you consent to the Promoter keeping your personal information on its database to use for future marketing purposes, including contacting you by electronic messaging provided that where required by the Spam Act 2003 (Cth), the Promoter includes a functional unsubscribe facility in each direct marketing communication it sends you that you may use to opt-out of any further such communications and provided that the functional unsubscribe facility complies with the Spam Regulations 2021 (Cth). By entering, you consent to receive email or SMS messages from the Promoter without any functional unsubscribe facility if they relate primarily to the conduct of this promotion.

The Promoter’s Privacy Policy (see https://www.coca-cola.com/au/en/legal/privacy-policy) includes information about:

(a) how to seek access to the personal information the Promoter holds about you and seek correction of the information; and

(b) how to complain about a privacy breach and how the Promoter will deal with such a complaint.

Entry

2 Your entry must be received during the Competition Period and will be deemed to be received only when received by the Promoter.  Where relevant, entry forms/scratch cards from any other competition cannot be used for this competition, and are void if copied, forged, stolen or interfered with.  Where relevant, submitted entry forms are the Promoter's property.  If you return a Qualifying Purchase your entry may be deemed invalid at the Promoter's discretion (unless the product is defective).  If online or SMS entry is available, you will receive a return message confirming your entry.  The Promoter is not liable for any problems with communications networks outside its reasonable control.  You are responsible for your own costs associated with entering.  If you enter using automatically generated entries or multiple phone numbers/email addresses/addresses/aliases, you may be disqualified.  

Prizes

3 Prizes and all elements of prizes must be taken as specified, as and when offered and cannot be altered or changed in any way by you or will be forfeited, and if forfeited, the Promoter will not be liable.  If you forfeit the prize or any element of the prize for whatever reason, you will not be given cash or any alternative prize as a substitute. Prize/s are subject to any additional terms and conditions imposed by the relevant supplier or the Promoter, including, as relevant:

(a) validity period/s;

(b) booking and availability of flights, accommodation and events;

(c) conditions of travel and conditions of entry into any event venues (including behaviour requirements, COVID safety requirements and applicable dress codes);

(d) conditions of ticket validity and any restrictions on ticket on-sale or transfer;

(e) travel dates and specified travel exclusion periods;

(f) any additional fees (payable by you) relating to changes made by you/your companion to a travel/event prize after it has been booked;

(g) the requirement to obtain all necessary documents to travel to any overseas location specified, including a current and valid passport and any visas required;

(h) a requirement to present your credit card when checking in to accommodation; and

(i) a requirement that any person taking the prize that is aged under 18 years old must be accompanied by their parent or guardian at all times.

4 You/your companion/s are responsible for all other unspecified costs related to the prize, including meals, transport, insurance (including excesses), in-room charges, additional taxes, mobile or data plans, installation costs, costs associated with ongoing use of the prize, etc.  Event tickets can only be used once and will be deemed invalid if copied.  The Promoter does not control entry to the relevant event location. The winner/s must keep their tickets safe and the Promoter will not replace lost or stolen tickets.

5 The Promoter is not responsible for any dispute between you and any person with whom you choose to, or choose not to, share a prize.

6 Where relevant, the Promoter accepts no responsibility if one or more of the events or activities awarded as part of the prize are abandoned, called off or postponed for any reason beyond the Promoter's reasonable control.  In that case you/your companion/s forfeit your entitlement to that event/activity and the Promoter may provide another item of equal or higher value, subject to any necessary approval by the state/territory gaming authorities.  Similarly, while the Promoter will make all reasonable efforts to ensure the participation of any specified celebrity/ies in the prize element/s, the Promoter and prize suppliers exclude, so far as legally permissible, all liability if for any reason the celebrity/ies do not attend the prize element/s due to circumstances beyond the reasonable control of the Promoter and prize suppliers (e.g. illness).  Unless otherwise specified by the Promoter, you will not be given cash or any alternative prize as a substitute for this altered prize element.  

General

7 Any material failure by you or (if applicable) your companion/s to comply with the conditions imposed by the prize supplier(s) may result in the prize being cancelled or withdrawn without liability for the Promoter or the prize supplier(s).

8 For event-based/travel prizes, you and (if applicable) your companion/s accept that some aspects of the prize may be inherently risky and that the prize may involve dangerous activities. 

9 If specified, in order to participate in the activity/activities awarded as part of the prize, you/your companion/s must comply with any applicable conditions (e.g. height, weight, health and fitness requirements).  You must ensure that you/your companion/s are healthy and fit enough to take the prize.  You/your companion/s must follow all requirements of the people responsible for managing the relevant activity/ies.

10 You/your companion/s must, if required by the Promoter, sign disclaimer and release forms provided by the Promoter in favour of the Promoter and other parties before taking the prize.  If you or any companion/s do not sign, your entry will be deemed invalid and you will lose any entitlement to a prize.

11 If you or your entry are deemed by the Promoter to breach these Terms and Conditions materially including if the prize is on set dates and you are unable to take the prize on the relevant date/s, your entry (or at the Promoter's discretion, all of your entries) may be discarded.  The Promoter may, at any time, require you to produce documentation to establish to the Promoter's reasonable satisfaction the validity of your entries and/or verifying your identity (including documentation establishing your identity, age, place of residence and place of employment).  Failure by the Promoter to enforce any of its rights at any stage does not waive those rights.

12 You must not:

(a) tamper with the entry process (including but not limited to manipulating the system via bots, script use, or any other means to circumvent the entry process);

(b) engage in any conduct that may jeopardise the fair and proper conduct of the competition;

(c) act in a disruptive, annoying, threatening, abusive or harassing manner;

(d) do anything that may diminish the good name or reputation of the Promoter or any of its related entities or of the agencies or companies associated with this competition;

(e) breach any law; or

(f) behave in a way that is otherwise inappropriate.

13 If companion/s can take the prize with you, you are responsible for your companion/s and the Promoter may disqualify all entries from, and prohibit further participation in this competition by, you or any or all of your companion/s if they materially breach these conditions, whether or not legally bound by them.

14 If you (or your companion/s, if applicable), in the reasonable opinion of the Promoter (and/or a medical professional, as relevant to the circumstances), are intoxicated, under the influence of alcohol or any other drug, behave aggressively or offensively, or behave in a manner which may diminish the good name or reputation of the Promoter or any of its related entities or the agencies or companies associated with this competition, is contrary to law or is otherwise inappropriate, the Promoter may cancel the prize or restrict you (and your companion/s) from participating in any elements of the prize, at its discretion.

15 The Promoter is not liable for entries, prize claims or correspondence that are misplaced, misdirected, delayed, lost, incomplete, illegible or incorrectly submitted for reasons outside the Promoter's reasonable control, including failure of any third parties to forward entry forms for inclusion in the draw, where relevant.

16 If any dispute arises between you and the Promoter concerning the conduct of this competition or claiming a prize, the Promoter will take reasonable steps to consider your point of view, taking into account any facts or evidence you put forward, and to respond to it fairly within a reasonable time.  In all other respects, the Promoter’s decision in connection with all aspects of this competition is final.

17  Prizes cannot be transferred or exchanged nor (except where cash is specified) redeemed for cash.  Without limiting any other term of these Terms and Conditions, all prizes (and elements of prizes) must be taken as and when specified, or will be forfeited with no replacement.  The prize values are correct as at the date of preparing these Terms and Conditions and include any applicable GST.  The Promoter is not responsible for any change in prize value.  You agree that if a prize (or element of a prize) is unavailable for any reason the Promoter may provide another item of equal or higher value, subject to any necessary approval by the state/territory gaming authorities.

18 If publication will take place, by entering, you request that your full address not be published.

19 Where relevant for instant win promotions, printing and other quality control errors outside the Promoter’s control will not invalidate an otherwise valid prize claim.  Every instant win prize claim in excess of the advertised prize pool will be honoured, unless the claim is rejected due to fraud or ineligibility under these Terms and Conditions.

20 If this competition cannot run as planned for any reason beyond the Promoter's control (for example due to software, hardware or communications issues, unauthorised intervention, tampering, fraud or technical failure, government directives, a pandemic, public health orders and the like), the Promoter may end, change, suspend or cancel the competition or disqualify affected entries/entrants, subject to any necessary approval by the state/territory gaming authorities.

21 The Promoter is not responsible for any tax implications arising from you winning a prize.  You should seek independent financial advice.  If for GST purposes this competition results in any supply being made for non-monetary consideration, you must follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.

Liability

22 You may have consumer rights under statute including under the Competition and Consumer Act 2010 (Cth), which may be relevant to any issue or problem you encounter in relation to this competition and cannot be excluded or restricted.  Nothing in these Terms and Conditions excludes or restricts those rights.  See www.accc.gov.au for more information about those rights.

23 Subject to the previous paragraph, the Promoter and the agencies and companies associated with this competition are not liable (including in negligence) for any loss (including indirect, special or consequential loss or loss of profits), expense, damage, personal injury (including allergies, skin conditions or other reactions, as relevant), illness or death suffered in connection with this competition or any prize, except for any liability which under statute cannot be excluded (in which case that liability is limited to the greatest extent allowed by law).   

24 Without limiting the previous paragraphs, the Promoter and the agencies and companies associated with this competition are not liable for any loss of, damage to or delay in delivery of prize/s, or for any damage that occurs to displayed prize/s (where relevant), due to circumstances beyond the Promoter's reasonable control.  Unless otherwise specified, prize/s will only be delivered to addresses in Australia.

25 This competition is in no way sponsored, endorsed or administered by, or associated with any social media platform, including Facebook, Instagram and Twitter.  You provide your information to the Promoter and not to any social media platform.  You completely release any relevant social media platforms from any and all liability.
